Terms of Service

Effective 25 October 2026

These terms are an agreement between you and Cogito Innovation (“Cogito”, “we”) for using cogito.cv, your Cogito account and our apps, including Partwise and OneTake. By creating an account or using our services, you agree to them. If you use our services for a school, choir or other organisation, you confirm you may accept these terms for it.

Your account

• You must be 13 or older, or use our apps through a school or teacher with the consent the law requires.
• Give accurate details and keep your sign-in secure. You are responsible for what happens under your account.
• Tell us at once if you think someone else has used your account.

Your content

You keep ownership of everything you create or upload, such as scores, arrangements, recordings, photos and messages. You give us permission to store, process, copy and display it only as needed to run the features you use, for example to sync it to your devices or share it with the people you choose. This permission ends when you delete the content or your account, except for copies others already received from you.

You are responsible for having the rights to what you upload. Printed music, recordings and lyrics are often protected by copyright, so upload only what you own, what is in the public domain, or what you have permission to use. If you believe something on our services infringes your copyright, email us with the details and we will act on it.

Acceptable use

Do not use our services to:

• break the law or infringe anyone’s rights;
• harass, threaten or harm others, especially children;
• share content that is sexual, hateful or violent;
• access other people’s accounts or data without permission;
• interfere with, overload or reverse-engineer our services, or use bots to access them without our permission.

We may remove content or suspend accounts that break these rules.

AI features

Some features use AI, for example to read sheet music, suggest notes or summarise a class. AI can make mistakes. Check its results before relying on them, especially before printing or performing. Do not use AI features to produce content that breaks these terms.

Purchases

Paid features, credits and subscriptions are shown with their price before you buy. Purchases in our iPhone and iPad apps are handled by Apple under Apple’s terms, including refunds. Credits have no cash value and cannot be transferred. Subscriptions renew until you cancel them in your App Store or account settings.

Our services

We keep improving our services, so features may change or end. We will try to warn you before removing something important you rely on. Some features are labelled beta and may be less reliable.

Ending your account

You can delete your account at any time. We may suspend or close an account that breaks these terms or puts others at risk, and will tell you why unless the law or safety prevents it.

Disclaimers and liability

Our services are provided “as is”. To the extent the law allows, we make no promises that they will be uninterrupted or error-free, and we are not liable for indirect or consequential losses or lost data. Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim or US$100. Nothing in these terms limits rights you have under consumer law that cannot be waived.

Law and disputes

These terms are governed by the laws of the State of California, USA. If a dispute arises, please contact us first so we can try to resolve it. If we cannot, the courts of California have jurisdiction, unless your local law gives you the right to bring a claim where you live.

Changes

We may update these terms. If a change is significant, we will tell you in the app or by email before it takes effect. Continuing to use our services after that means you accept the new terms.
